Yoh Integrates OFCCP Compliance into Hiring Process

Demographic data logged automatically for federal contractors tapping Yoh’s high-impact talent

PHILADELPHIA—November 12, 2008—Last year federal contractors were fined $51.7 million for failing to comply with Office of Federal Contract Compliance Programs (OFCCP) regulations, which require the solicitation and documentation of job applicants’ demographic data. Most talent firms take a hands-off approach to this problem, while others may provide a compliance service to an individual client, on request. Both positions are supported by industry trade groups.

Today, Yoh puts the interests of consultants first by integrating an end-to-end OFCCP compliance process into its standard recruitment program. The new process, which begins whenever candidates apply for government positions online that are advertised by Yoh, automates the solicitation and recording of candidates’ gender, race, and ethnicity, to ensure adherence to non-discrimination obligations.

“This is, historically, a cumbersome requirement for federal contractors to meet, which is why so many overlook it,” says Bill Yoh, President and CEO of Yoh. “We’re giving companies peace of mind knowing that job applicants recruited by Yoh have had their demographic data collected and securely stored, according to the strict requirements of the OFCCP. Partnering with Yoh makes it easy to maintain compliance.”

The OFCCP is an organization in the U.S Department of Labor that administers and enforces laws to ensure all applicants have equal employment opportunity without regard to race, color, gender, religion, or national origin. OFCCP compliance applies to all federal contractors and subcontractors who do more than $10,000 in government business annually. These laws aim to prevent discrimination in employment decisions, including having government contractors identify and record the gender, race, and ethnicity of every job applicant, and tracking the status of these applicants throughout the hiring process.

Yoh’s rigorous OFCCP compliance process ensures candidates are not discriminated against while providing crucial documentation that federal contractors can use in the event their company is audited by the Federal government for alleged OFCCP violations.

Penalties for violating OFCCP regulations include fines, suspension or cancellation of all current federal contracts, and debarment from future federal contracts. While the OFCCP’s regulations have existed since 1965, a 2005 amendment, known as the “Internet Recordkeeping Rule,” now requires government contractors to follow these rules for online applicants. Many companies are not aware of this change, or haven’t conceived a cost- and time-efficient means for adhering to it. By partnering with Yoh, government contractors can easily comply with all OFCCP regulations in a simple, hands-off, and cost-efficient manner.
